Assistance animals are the most misunderstood area of landlord-tenant pet law. Here's what actually applies under federal law:

Not Pets Under the Law

Service animals and ESAs are classified as reasonable accommodations under the Fair Housing Act — not pets. Most pet policies, breed bans, and weight limits do not apply to them.

Documentation Rules

Landlords can request reasonable documentation of disability and need — but cannot demand medical records, specific diagnoses, or registration from questionable online "ESA registries."

No Pet Fees Allowed

Pet deposits, pet rent, and pet fees cannot be charged for verified assistance animals. Tenants remain liable for actual damage caused by the animal — that's the limit.

Important: Violations of federal fair housing law in assistance animal cases can trigger significant civil penalties, actual damages, and mandatory attorney fees. HUD complaints are also available. Landlords should verify any ESA/service animal denial with counsel first — and tenants who've been wrongfully denied should act quickly while documentation is fresh.
